1. IDENTIFICATION
This website, www.newtone-brand.com (the“Site”), is published by Firme Design, S.A.R.L., a limited liability company with with a share capital of 2,000 euros, registered with the Marseille Trade and Companies Register under number 843 215 914, with its principal place of business located at 1590 Chemin du Clauvier, 13360 Roquevaire.
The Site is hosted by Shopify Inc., whose principal place of business is located at 126 York St., Ottawa, ON K1N 5T5, Canada.
Access to the Site and use of its content are subject to the terms of use described below. By accessing and browsing the Site, the user unconditionally accepts the following terms.
2. INTELLECTUAL PROPERTY
2.1 Ownership
Newtone is the owner of the Website's domain name.
The Website as a whole, as well as its constituent elements (including, but not limited to, text, site maps, software, animations, photographs, videos, illustrations, diagrams, graphic representations, logos, etc.), constitute intellectual works protected by Articles L. 111-1 et seq. of the Intellectual Property Code. They are the exclusive property of Newtone, which alone is authorized to use said intellectual property rights as well as the related moral rights, trademarks, designs, intellectual works, software, databases, interpretations, and images of individuals, whether by origin or by virtue of a license or express authorization.
2.2 Penalties
The use of all or part of the Site—including through downloading, reproduction, transmission, display, or distribution—for any purpose other than the user’s personal and private, noncommercial use is strictly prohibited. Any violation of Newtone’s rights exposes the perpetrator to the penalties provided for both by the Intellectual Property Code—specifically regarding copyright infringement (Article L. 335-1 et seq.) and trademark infringement (Article L. 716-1 et seq.)—and by the Civil Code with respect to civil liability (Article 9, Articles 1382 et seq.).
2.3 Hyperlinks
The creation of any hyperlinks to any of the web pages or elements comprising the Site is prohibited without Newtone’s prior written authorization, which may be revoked at any time. All websites containing a hyperlink to the Site or any of its components are not under Newtone’s control, and Newtone therefore disclaims all liability (including editorial liability) regarding access to and the content of such websites.
3. LIABILITY
Newtone strives to ensure, to the best of its ability, that the information published on the Site is accurate and up-to-date, and reserves the right to correct the content at any time and without notice. However, Newtone cannot guarantee the accuracy, precision, or completeness of the information made available on the Site, and such information does not constitute a guarantee or commitment on the part of Newtone to the user.
In particular, Newtone shall not be held liable for:

4. CHANGES TO THE LABELING
Newtone hereby informs users visiting the Site that these terms and conditions may be modified at any time. Such modifications are published online and are deemed to have been accepted without reservation by any user who accesses the Site after they are posted online.
5. DISPUTES
These terms and conditions are established in accordance with French law, and in particular the provisions of Law No. 2004-575 of June 21, 2004, on confidence in the digital economy, and Law No. 78-17 of January 6, 1978, on information technology, data files, and civil liberties. The French courts have territorial jurisdiction to hear any dispute arising from the use of the Site, unless otherwise provided by Regulation No. 44/2001 of December 20, 2000, on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (Brussels I).
