1. IDENTIFICATION
This website, www.newtone-brand.com (the“Site”), is published by FIRME DESIGN, S.A.R.L., a limited liability company with with a share capital of 2,000 euros, registered with the Marseille Trade and Companies Register under number 843 215 914, with its principal place of business located at 1590 Chemin du Clauvier, 13360 Roquevaire.
The Site is hosted by Shopify Inc., whose principal place of business is located at 126 York St., Ottawa, ON K1N 5T5, Canada.
Access to the Site and use of its content are subject to the terms of use described below. By accessing and browsing the Site, the user unconditionally accepts the following terms.
2. THE CUSTOMER
All customers must be at least eighteen (18) years of age and have legal capacity or hold parental consent to place an order on the Site (hereinafter the “Customer”). When entering the Customer’s personal information in the “My Account” section, the Customer must ensure that the required information provided is accurate and complete. In the event of an error in the recipient’s address, FIRME DESIGN shall not be held liable for any failure to deliver the product.
The Customer acknowledges having read, at the time of placing the order, the General Terms and Conditions of Sale and declares that they accept them without reservation.
3. PRODUCTS
The products are presented on the Site as accurately as possible, using descriptions and images (hereinafter the “Products”). Most of the products offered for sale by FIRME DESIGN are also available at its warehouse or retail locations. The colors of the items on the Site may differ slightly from their original colors. Under no circumstances may these visual differences be interpreted as defects in conformity or result in the cancellation of the sale.
If a Product is unavailable after an order has been placed, the Customer will be notified by email or phone of the out-of-stock Products. The Customer may then request to cancel or exchange the order within five (5) business days (Monday through Friday) by contacting customer service via email at eshop@newtone-brand.com.
4. ORDERS
The Products remain the property of FIRME DESIGN until full payment for the order has been received. All risk of loss or damage to the goods is transferred to the Customer as of the moment the Customer or a third party designated by the Customer—other than the carrier provided by Newtone—takes physical possession of such goods.
All orders are subject to prior acceptance of these General Terms and Conditions of Sale. The Customer’s acceptance of these General Terms and Conditions, as well as the entry of their banking information, constitutes an irrevocable acceptance of the terms of sale and payment, and will confirm the Customer’s order. The sale will not be finalized until the order is confirmed. newtone-brand.com reserves the right to cancel any order from a customer with whom there is a dispute regarding payment for a previous order. The information provided by the buyer when placing the order is binding on the buyer. In the event of an error in the recipient’s address details, the seller shall not be held liable for any inability to deliver the product.
To confirm their order, the Customer must follow several steps, in accordance with the procedure established by FIRME DESIGN. Before finalizing their order, the Customer has the opportunity to review the order details and total price, and to correct any errors, before confirming the order to indicate their acceptance. Any order confirmed by the Customer constitutes a sales contract and acceptance of all the terms and conditions set forth herein.
FIRME DESIGN will confirm acceptance of the Customer’s order via the email address provided by the Customer. The sale will not be finalized until the order has been confirmed.
FIRME DESIGN reserves the right to refuse any order from a Customer with whom there is an outstanding dispute regarding payment for a previous order.
4. PRICES
Product prices are listed in euros, including all taxes, but excluding processing and shipping fees.
All orders, regardless of their origin, are payable in euros.
The applicable VAT rate is the French VAT rate.
FIRME DESIGN reserves the right to change its prices at any time. However, the applicable prices for the Products are those in effect at the time the order is placed, subject to the availability of the Products on that date.
5. PAYMENT
The payment methods accepted by FIRME DESIGN are listed at the beginning of the ordering process and are reiterated on the payment page.
The Customer certifies that he or she is fully authorized to use the payment methods to pay for the order and that these payment methods allow him or her to pay the total price of the order.
FIRME DESIGN uses the secure online payment system SHOPIFY PAYMENT & PAYPAL. Banking information is transmitted in encrypted form directly to the bank and is not stored by FIRME DESIGN under any circumstances.
6. DELIVERY
Shipping is free on orders of 150 euros or more within mainland France.
We use La Poste (Colissimo with tracking and signature upon delivery or Colissimo pickup point) to deliver your orders in France.

8. INTELLECTUAL PROPERTY
8.1 Ownership
Newtone is the owner of the Website's domain name.
The Website as a whole, as well as its constituent elements (including, but not limited to, text, site maps, software, animations, photographs, videos, illustrations, diagrams, graphic representations, logos, etc.), constitute intellectual works protected by Articles L. 111-1 et seq. of the Intellectual Property Code. They are the exclusive property of Newtone, which alone is authorized to use said intellectual property rights as well as the related moral rights, trademarks, designs, intellectual works, software, databases, interpretations, and images of individuals, whether by origin or by virtue of a license or express authorization.
8.2 Penalties
The use of all or part of the Site—including through downloading, reproduction, transmission, display, or distribution—for any purpose other than the user’s personal and private, noncommercial use is strictly prohibited. Any violation of Newtone’s rights exposes the perpetrator to the penalties provided for both by the Intellectual Property Code—specifically regarding copyright infringement (Article L. 335-1 et seq.) and trademark infringement (Article L. 716-1 et seq.)—and by the Civil Code with respect to civil liability (Article 9, Articles 1382 et seq.).
8.3 Hyperlinks
The creation of any hyperlinks to any of the web pages or elements comprising the Site is prohibited without Newtone’s prior written authorization, which may be revoked at any time. All websites containing a hyperlink to the Site or any of its components are not under Newtone’s control, and Newtone therefore disclaims all liability (including editorial liability) regarding access to and the content of such websites.
9. LIABILITY
Newtone strives to ensure, to the best of its ability, that the information published on the Site is accurate and up-to-date, and reserves the right to correct the content at any time and without notice. However, Newtone cannot guarantee the accuracy, precision, or completeness of the information made available on the Site, and such information does not constitute a guarantee or commitment on the part of Newtone to the user.
In particular, Newtone shall not be held liable for:
- any inaccuracy, error, or omission in the information available on the Site;
- for any damages resulting from a third-party cyberattack that has led to a modification of the information made available on the Site;

10. CHANGES TO THE LABELING
Newtone hereby informs users visiting the Site that these terms and conditions may be modified at any time. Such modifications are published online and are deemed to have been accepted without reservation by any user who accesses the Site after they are posted online.
11. DISPUTES
These terms and conditions are established in accordance with French law, and in particular the provisions of Law No. 2004-575 of June 21, 2004, on confidence in the digital economy, and Law No. 78-17 of January 6, 1978, on information technology, data files, and civil liberties. The French courts have territorial jurisdiction to hear any dispute arising from the use of the Site, unless otherwise provided by Regulation No. 44/2001 of December 20, 2000, on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (Brussels I).
